Maryland Gareau: A green card IS a visa...it's just a special one that can be the step before citizenship. It has less restrictions on it and means you can live in the US as long as you wish. You don't need a green card to legally be in the US, simply a visa. :D You are definitely legal. Don't worry. What you have is called a "non-immigrant" type visa. Being an immigrant, by the way, isn't a bad thing at all. It's being an ILLEGAL immigrant that makes everyone so mad. You and your family are doing everything right and legally. Coleman Coscia: IT'S ONLY TEMPORARY
Flor Lizardi: If you have visas as you described, then you are legal non residents. You dont have to have the permanent resident card ( the green card ), to be in the USA, but to stay in the USA on a permanent basis you have to either have one or become a citizen. If you can stay in the USA as long as you have a visa that is current though.
Wilmer Skid! more: The definition of an immigrant can be confusing. An immigrant is someone who resides in the United States with a Permanent Resident Card (green card), that is considered either a 10 year card, or a temporary 2 year card based on marriage to a US Citizen or Entrepreneurship. Refugees & Asylees are sometimes referred to in this manner as well, although they have a very different circumstance.A non-immigrant is any individual who has entered the US with a SPECIFIC visa... Such as a work visa (H1B, H2B, etc...), student visa (J1,F1..), Fiance visa (K1,K2,K3,K4)... and several other visa classifications. Your family would be considered as non-immigrants because you have each entered the US in a legal manner & continue to withhhold your valid non-immigrant visas. If, however, your mother's employer decides to petition for her to become a Permanent Resident, then both you and your brothers may apply as derivatives with her & if all goes well & you're approved, you will then g! et a permanent resident card and be considered immigrants, ins! tead of non-immigrants....Show more
